These Terms and Conditions and the laws of Thailand govern conducting business with BB eBooks. By using the websites or services of BB eBooks, you agree to these Terms and Conditions and that you will submit to the exclusive jurisdiction of the courts of Thailand in any dispute that may arise. “Client”, “you”, and “your” refer to you, the person or authorized representative conducting business with BB eBooks. “BB eBooks”, “the company”, “we”, “us”, “our”, and “ours” refer to BB eBooks Co., Ltd., a registered company in the Kingdom of Thailand residing at 98/28 On Nut 36, Sukhumvit 77 Road, Suan Luang, Bangkok 10250, with a business registration number of 0-1055-56042-59-3 (Ministry of Commerce affidavit available upon request).

Confidentiality and Privacy Statement

We are strongly committed to protecting your confidentiality and privacy. All information you provide us in conducting business is considered confidential, including your content, working documents, metadata, email address, and personal information. Only authorized members within the company on a need-to-know basis use your information to conduct business. Accordingly, we do not sell, rent, or otherwise share your information to any third party without your express permission. The only exception to this is sharing transaction receipts, as required by Thai law, with the company’s contracted accountants and the Thai Revenue Department. You may conduct business with the company under a pen name.

Copyrights

The company assumes that all content, including text, images, fonts, and multimedia, submitted by the client is not stolen, plagiarized, or an infringement on anyone else’s copyright. Therefore, the company will take no part in any copyright litigation arising between the client and a third party. The company does not claim to own the copyright in the content, design, or source code of any finished products created for the client. However, to serve all our clients more efficiently, the company retains the right to reproduce and adapt non-text, non-design portions of any source code created for the client.

Updates to the Terms and Conditions

We reserve the right to update at any time our Terms and Conditions and will make them available on our websites as applicable.

Usage Permissions and Restrictions

Usage Permissions

You are welcome to reproduce, adapt, and distribute our images and other content that is publicly available for free on our main website, including HTML, CSS, JavaScript, and other code. You may so use the BB eBooks logo, but only under a fair use policy to refer to BB eBooks or our affiliates. Content generated by another user may be under copyright by that user, so please consult with that user prior to your use. We are not responsible for the use of our content outside the company’s property or web domains.

Incoming Links

You are welcome and encouraged to link to our main website and its individual pages and sections. We are not responsible for the content at any incoming link’s site of origin.

Usage Restrictions

The programs that run the company’s business and web domains are protected by Thailand’s Trade Secrets Act B.E. 2545 and Computer Crime Act B.E. 2550, whose violations are subject to civil liability, criminal penalties, or both. Notably, you must not access areas of our server protected by password or firewall, or use our other programs intended to be outside public use, without express permission from the company. Notable, too, is that malicious code injection, cross-site scripting, and deliberate buffer overflow are prohibited.

Payment and Services

Agreement of Services and Price

The company will perform services for you upon a verbal or written agreement (email is preferred) on the price for those services. After this agreement, modification or cancellation will only be made on case-by-case agreed-upon terms.

Invoicing and Payment

Upon completing the agreed-upon services, we will issue you an invoice for which you will have 30 days to either pay in full or dispute the charge. You are not expected to pay transfer fees, currency conversions, sales tax, Value Added Tax (VAT), or other similar amounts that often accompany financial transactions. You only have to pay what is clearly documented on the invoice. If you dispute the charge, you must explain in writing why the services performed by the company were unacceptable.

Receipt

Upon payment to the company, we will issue you a receipt detailing the financial transaction, which will then be considered completed.

Additional Services and Changes

After a completed transaction, BB eBooks can perform additional services on a case-by-case basis. Any error you discover that was the fault of the company will be immediately corrected at no charge to you. Changes that are outside the scope of services specified in the original agreement are subject to case-by-case agreed-upon terms.

Service and Content Restrictions

Refusal of Service

BB eBooks reserves the right to refuse service to any client at any time without explanation. If an agreement to begin work has been made, BB eBooks will promptly inform the client of its refusal of service and refund any advance payments for that work.

Pornographic Content

BB eBooks refuses to serve any client who submits content consisting of 1) obscene pornographic images, 2) depictions of grotesque sexuality such as necrophilia or bestiality, or 3) child pornography, in violation of Article 287 of the Thai Criminal Code. We will report any submission we receive of child pornography to the Royal Thai Police.

Lèse Majesté

Lèse Majesté is a serious criminal offense in Thailand. Accordingly, BB eBooks refuses to publish, store, distribute, or work on content, or partake in discussion, that potentially “defames, insults, or threatens” any monarchy of Thailand in violation of Article 112 of the Thai Criminal Code. This article is construed broadly, and any violation is subject to 3–15 years imprisonment. Any users on our websites who post, upload, or link content that we find to violate this article will have their IP addresses blocked immediately.
